Miley Cyrus, also known as Hannah Montana, has a very active fan club, much as other teen sensations have had over the years. The benefits for those in such a fan club usually include memorabilia, little fan goodies, the latest news about the star and, in this case, the fans believe they were promised easier access to Miley's concert appearances.Yes, the fan club members believed they would have access to priority seating at the sold-out concerts of Miley, the daughter of Billy Ray Cyrus. As Hannah Montana on the Disney Channel, her current fame eclipses any achy breaky heart past glories. She's the fourteen year-old whose fans are really fanatics in all meaning of the word.
In Tennessee, a lawsuit was filed which claims that the fan club bosses knew they wouldn't be able to meet the demands for concert tickets. Companies targeted in the lawsuit, Interactive Media Marketing and Smiley Miley, are being sued for triple damages for all members of the lawsuit plus court costs.
The lawsuit, in the name of a New Jersey woman who joined the fan club at MileyWorld.com mainly for the promise of concert ticket ease, claims the lawsuit is "for all fans who feel similarly situated." According to the attorney representing the fans in the class action lawsuit, "While the club and the website do not guarantee ticket availability, they explicitly state that members who log on shortly after tickets become available, they will have a good opportunity to get tickets."
MileyWorld claims the lawsuit is frivolous.

I wonder how annoyed Billy Ray Cyrus is by the fact that his daughter is a bigger star as a FAKE character than he was as a real country muzak star. :P But anyway my kids love this show.

Not that I am a country music fan, but IIRC, Billy Ray had quite the following back in the day. I would also think that his is quite proud of his daughter.

I think the lawsuit is frivolous! The way i heard it the big problem was that scalpers bought up alot of the tickets, so it isent really the fan clubs fault!

This is Hannah Montana...if people actually thought about the facts instead of unreasonable obsession with a 14-yr old "pop star" then.....think about it folks...I expect this case to be thrown out in 5...4...3...2...1...now!

Sounds like a perfectly legitimate class action lawsuit to me. Massive breach of contract. I'm assuming people pay to join the fan club, and I'm assuming the fan club advertised one of the perks as guaranteed/special access to concert tickets. A class action always has one person as a representative plaintiff who sues on behalf of "all people similarly situated." For what it's worth, IAAL.

Hey...I joined the fan club in order to get tickets as a surprise for my daughter.
As soon as I entered the secret code that would let me buy tickets early, I got a reply that said there were no tickets available. I signed on again when they went on sale to the general public. I still couldn't get tickets.
I actually thought it was a little stinky that I joined (and paid) for the membership and sitll couldn't get tickets.
What I don't understand is why they didn't add additional shows. I know it couldn't be done everywhere, but it seems it wouldn't be that hard to have a second night of shows in the same city. They aren't generally back to back.

Fan clubs and such are at the whim of the areans and the promoters. The entertainers has nothing to do when and how tickets are put on sale and to whom they are sold to. The issue that fan clubs at times can get early sales to some concerts is totally up to the promoting agency!

I joined a year ago before a concert was even announced. I had no porblem getting tickets and there was never a mention of "if you join you will get tickets" It stated that you will be eligible for pre sale tickets per availability. Just another stupid lawsuit to clog up the legal system

Grow up people!!! I think it's a shame that you can't get the tickets. Especially when you pay to get into a club. But it sold out in minutes. Her marketing people should've realized this and should have gotten into high gear and scheduled another concert. And knowing this now, if they can't do the job-get rid of them and hire who look after her wellfare! All people want to do is sue! This to me is a lame lawsuit!! It happens. We can't always get what we want. I guess had it happened to me I would've been totally dissappointed~but never ever thought to sue someone over not being able to go to a concert. And I know my grandkids would love to see her too. And they to will learn of dissappointment. I'm not being mean. Just realistic!!!!

Did they sue Elvis, The Beatles, Garth Brooks (in my day Duran Duran)...come on get a grip. It's another case of people who can't get what they want when they want it throwing a temper tantrum. It's all these children who grew up getting everything they wanted handed to them and now they think that the court system is going to hand them something they can't get. Deal with it, life is full of disappointments. Do you really think it's a teenagers fault she's so popular the crooks in the country want to scalp her tickets????? Suck it up and move on.

Things of this nature is what clogs up our legal system. There are much more important issues out there other than a few people throwing a tantrum because they can't get tickets to a concert. Please, people, grow up and sue over something that truly could make a difference in our world today. I mean, there are so many issues to choose from, surly you could find something much more worthy.

I was one of the Mom's that had to pay $7oo.oo for 2 tickets. Ya don't hear me threatening a lawsuit. It is a shame that the tickets were so hard to come by, however they could still be found if you were willing to pay the price. This was a situation where the scalpers bought up the tickets and then sold them for very high prices. The lawsuits should be aginst the scalpers not the fan club. By the way it was a fantastic concert.... I would see her again... she is very talented as Hannah or Miley.

Obviously, some people have no life. How could anyone that belongs to a fan club expect to get priority access to tickets. What a bunch of fools. I wish the courts would start fining people for frivilous lawsuits, especialy the dumb lawyers that represent them.

Concerts were sold out within minutes of tickets sales being opened. Seems to me that scalpers and big ticket outlets had standing orders for the majority of tickets as soon as they became available. Certainly not illegal, but definitely a way to get fans and parents of fans p.o.'d. Best way to solve that would be to reserve the majority of tickets for box office sales. That and limit the number of tickets any individual can buy. Several comments mentioned B.R. Cyrus' past fame. However, none of the comments I read mentioned his own television series. Maybe Doc was mentioned in the comments I didn't read. As for him being jealous, I don't think so. I think he's as happy and proud as any father can be for his daughter.

If you have a million kids in the fan club it would stand
to reason that every fan club member would not be able
to get special seating. Their just aren't enough seats
available.

Billy Ray was great when he was breaking achy breaky hearts and now he has matured and is doing a great job as a father. He can be proud of the great example his daughter is providing for the pre-teen and teens....she's talented and sincere.....just pray she doesn't go the way of Britney Spears,,,,as for the suit for tickets...I joined the George Strait fan club with membership seating privileges...but could not always get into that block of seats...when tickets go on sale all over the country at one time... you can expect you might get bumped..accept it...put your big girl panties on and deal with it!
